General

In British Columbia, in most cases you have two years in which to commence a legal action against the party at fault.

Claims against ICBC

However, if you have been injured by an uninsured driver or a person whose identity unknown to you then you must name ICBC as a defendant in the action. In these circumstances your limitation period is one year from the date your claim arose.

Claims against city/municipality

If your injury involves a city or a municipality, you must notify the city or municipality within sixty days of your injury and the nature of your injury. Under these conditions, you must commence an action against the city within six months from the date your claim arose.
