In British Columbia all companies are regulated by the Company Act. One or more persons may form a company for the purposes of carrying out any kind of business in the Province.

A company has the capacity of a natural person and can do anything that a person can do and can consist of one or more persons. In the event that there is only one person in the company that person is the sole director and both the president and secretary.

Before incorporating a company it is important that one obtains both taxation advice and legal advice. Depending on the nature of the business the limited liability offered by a company may not be worth the actual cost of incorporation and the annual maintenance required to keep the company in good standing. There is a certain level of earnings, however, where it becomes financially beneficial to have your business operated through a limited company. You should consult your tax adviser in this regard.
