Percentage fees are also known as contingency fees. Contingency fees means that you lawyer will get paid a percentage of the amount recovered on your behalf.

In British Columbia your lawyer can be paid on the basis of a contingency fee for any type of case however all contingency fees that involve matrimonial matters must be approved by the court.

Contingency fees are most commonly used by personal injury lawyers, however the lawyer fees in any civil case can be regulated by a contingency agreement entered into between the lawyer and client.

In motor vehicle cases the maximum amount that a lawyer can charge is 33 1/3% and in all other cases the maximum that can be charged by your lawyer is 40%.

In some cases the lawyer might even agree to pay the out of pocket expenses that are incurred until after the trial is finished.
