| Under the
Power Attorney Act an individual can appoint another person to execute any
document that he/she might be able to execute themselves.
Powers of attorney can be either general or restricted. A restricted power of attorney only allows the recipient of the power to do those things that are set out in the power of attorney. An unrestricted power of attorney allows the recipient to do anything the maker thereof could do. If the purpose of the power attorney is to deal with land then it will have to be on a special form in order to make it registerable and therefore useable in a Land Title Office. A power of attorney, once given, may be revoked in writing. Before executing a power of attorney you should consult with your lawyer to ensure that it accomplishes what you intend. |
